As a service provider:For our clients, Spud&Code acts as an Operator (under POPIA) or a Data Processor (under GDPR). We process data strictly according to our clients' instructions.

As a business:For visitors to this website, Spud&Code acts as the Responsible Party (under POPIA) or the Data Controller (under GDPR).

3. Data we collect

We collect and process personal information to provide our web development and digital services, including:

  • Identity & contact data: Name, email address, and business details.
  • Juristic data:Under POPIA, we also protect the personal information of “Juristic Persons” (registered companies and legal entities).

Future scope: This site does not currently use cookies or analytics tracking. When website analytics are introduced, this section will be updated to reflect the data collected and the tools used.

4. How we use your data

We only process your data when we have a legal basis to do so, such as:

  • Contractual necessity:To deliver the agency services you've hired us for.
  • Consent: When you submit our contact form.
  • Legitimate interest: To improve our website and protect against security threats.

5. International data transfers

Spud&Code is based in Cape Town, South Africa. However, we use global infrastructure (such as cloud hosting and professional SaaS tools) to deliver our services. We ensure that any personal information transferred outside of South Africa or the EEA is protected by industry-standard security measures and compliant data processing agreements.
